Recently, the Animal and Plant Health Agency (APHA) released new guidance regarding the triangular trade rules for re-exporting Animal By-Products (ABP) to the European Union (EU) and Northern Ireland (NI). This update follows discussions with the European Commission and aims to clarify and streamline the processes involved.

Understanding Triangular Trade

Triangular trade refers to a scenario where a product is imported into Great Britain (GB) and subsequently re-exported. For instance, a product might move from France to GB and then to Germany. This guidance aligns with the EU's current requirements to prevent consignment rejections at EU Border Control Posts.

Key Points of the APHA Update

  1. Scope of Guidance:

    • The guidance is relevant for exports to the EU and movements to NI from GB.

    • It does not cover movements of retail products to NI under the Northern Ireland Retail Movement Scheme.

  2. Processing Requirements:

    • ABP imported into GB from any country cannot be re-exported to the EU or moved to NI unless the product undergoes further processing in GB.

    • Products that are merely unloaded, stored, reloaded, or rewrapped in GB are not eligible for re-export to the EU or movement to NI outside the NI Retail Movement Scheme.

  3. Transit Procedure:

    • Businesses can utilise the transit procedure to move goods from RoW to NI via GB, bypassing the triangular trade rules.

    • The transit process involves several steps:

      • Pre-notification on IPAFFS and accompaniment with the relevant GB health certificate.

      • SPS checks and clearance for transit through GB.

      • Pre-notification through TRACES for entry into NI.

      • The consignment must be accompanied by the relevant EU Export Health Certificate (EHC) issued at the RoW origin and checked at an Inspection Facility in NI.
